Terms of Service

Welcome to Encore. These Terms of Service ("Terms") govern your use of the Encore mobile application (the "Service"). By using Encore, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use Encore. By creating an account, you confirm that you meet this age requirement and that you have the right to enter into these Terms.

2. Your Account

To use most of Encore's features you need to create an account. You agree to provide accurate information and to keep your password secure. You are responsible for all activity that happens under your account. If you believe your account has been compromised, contact us at hello@encoreapp.to.

3. Your Content

Encore lets you create concert logs, ratings, reviews, lists, comments, and other content ("Your Content"). You retain ownership of Your Content.

By posting Your Content on Encore, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute Your Content within the Service. This license exists only so we can operate the Service — for example, displaying your reviews to other users or showing your stats on your profile. The license ends when you delete the content or your account.

You agree that Your Content will not:

• Be illegal, harassing, threatening, hateful, or violent
• Infringe anyone's intellectual property rights
• Contain spam, malware, or deceptive content
• Violate anyone's privacy or expose private information without consent
• Impersonate another person or misrepresent your identity
• Promote illegal activity

We may remove content that violates these Terms and may suspend or delete accounts of users who repeatedly violate them.

4. Acceptable Use

You agree not to:

• Use Encore for any illegal purpose
• Attempt to break, reverse engineer, or scrape the Service
• Interfere with other users' use of the Service
• Create multiple accounts to evade rate limits or moderation
• Use automated tools to access the Service without our written permission
• Attempt to gain unauthorized access to any part of the Service

5. Encore Plus Subscription

Encore offers an optional paid subscription ("Encore Plus") with additional features such as advanced stats, year-in-review, unlimited custom lists, and an ad-free experience.

Pricing and Billing

Subscriptions are sold through the Apple App Store. Current prices are displayed in the app. Payment is charged to your Apple ID account at confirmation of purchase.

Free Trial

The annual plan includes a 7-day free trial for new subscribers. If you do not cancel before the trial ends, you will be charged the annual subscription price. The trial converts automatically into a paid subscription.

Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. Renewal is charged to your Apple ID within 24 hours before the period ends, at the then-current price.

Managing and Cancelling

You can manage your subscription, including cancellation, through your Apple ID account settings. We cannot cancel subscriptions on your behalf.

Refunds

Refund requests for App Store purchases are handled by Apple. We do not process refunds directly. You can request a refund at reportaproblem.apple.com.

6. Concert Data

Encore aggregates concert data from various public sources. We aim for accuracy but cannot guarantee that all event details (dates, venues, lineups, prices) are correct or current. Always verify event details with the official source before traveling to or purchasing tickets for a show.

7. Intellectual Property

The Encore name, logo, app design, and code are owned by us. You may not use them without our written permission. Artist names, album art, venue names, and concert information are the property of their respective owners.

8. Termination

You can delete your account at any time via Settings → Delete Account. We can suspend or terminate your account if you violate these Terms or use the Service in a way that could harm us, other users, or third parties.

9. Disclaimers

Encore is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Encore and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability to you for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or €50, whichever is greater.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict of laws principles. Any disputes will be resolved in the courts of Portugal, unless your local law gives you the right to bring claims in your country of residence.
